Xantek provides business telephone systems to businesses throughout the world. We endeavor to maintain the maximum in service time, consistent with the available technology. Our telepone switching equipment is housed in secure data centers at various locatoins. Equipment is provided with backup power sources in the event of public power service interruptions. And, of course, all of our telephone switches have redundant backup equipment. There are, however, circumstances beyond our control which may impair our ability to provide continued service. Xantek will not be responsible for any direct, incident, indirect, special, punitive, exemplary or consequential damages, including but not limited to loss of data, lost of revenue, profits or anticipated profits, or damages arising out of or in connection to the use or inability to use the service.

You will be billed periodically for your service. All bills are due within thirty days of invoice date. Failure to pay your bill when due could result in interruption of your service. In the event of a service interruption, you will only be alowed to make calls to 911 and to our technical support line. In the event of continued failure to pay your bill, your service may be permanently disconnected. If this occurs, no calls of any type will be possible from your phones.

Violation of the laws of any competent jurisdiction may result in immediate account termination and/or disconnection of the offending service. Any attempt to access Xantek services or servers by unauthorized means may also result in immediate account termination and/or disconnection.

All business service plans provide for unlimited calling to US and Canadian telephones. However, certain types of businesses (technical support centers, telemarketing centers, etc.) may have higher than normal usage patterns. Xantek defines reasonable business use to be 1000 minutes per installed telephone per month. If your usage exceeds this “reasonable business use”, Xantek may impose additional monthly charges for your service. If your business requires higher than normal phone usage, you can negotiate a high usage monthly rate at the time of service installation, or at any future time.

Business installations outside the US are covered by different rate plans, which will be provided at the time of your order.

Calls to non US/Canada destinations will be billed at per minute rates. Such rates are available by calling our technical support line.

All business systems installed within the US include 911 service. Internet 911 service (e911) is somewhat different from telephone line 911 service, in that it is difficult to determine the location from which the call is made. e911 relies on the caller id sent when you make the call. Your location is maintained in a database, which associates a location with the caller id. If you change your business location or caller id, it is your responsibility to notify us of such change. Otherwise, you may have to explain your new location to the e911 operator, which may delay emergency response. You can determine your location from the e911 datbase at any time by dialing 933.

By using Xantek’s e911 service, you agree that Xantek, its contractors, executives, members, customers, agents, employees, carriers, 911 providers, and any anyone else associated with Xantek will not be liable for emergency calls failing, even if it is determined that it is the fault of Xantek or its associates.
